INFORMATION ON THE PROCESSING OF PERSONAL DATA PROVIDED BY FILLING IN THE CONTACT FORM pursuant to art. 13 OF EU Regulation 2016/679

The website www.inferrara.it (the “Site”) hosts a technological platform managed by PO DELTA TOURISM Srl, located in Lido degli Estensi (FE) - 44029 - Via Manzoni n.6 - VAT: 01956130387, which facilitates the connection between Tourism Operators and “Users” for the purpose of online buying and selling of their tourism services.
 
On the Marketplace, Users can check availability, send booking requests, and purchase both accommodation and non-accommodation services, sold either by PO DELTA TOURISM Srl or by other Tourism Operators. It is always clearly indicated on the Site whether the service is marketed by PO DELTA TOURISM Srl or another Operator. In the latter case, PO DELTA TOURISM Srl, as a mere provider and technical manager of the Platform, is not a party to the sales contract between the User and the Supplier, which is concluded exclusively between the Seller and the User under the terms and conditions of the applicable General Contract Terms.
 
In light of this, pursuant to EU Regulation No. 2016/679 and the current national legislation, the user is informed that, regarding the processing of their personal data provided and collected through the use of the Platform and the search and booking of services via the Marketplace:


Data controllers

The data controller of personal data is PO DELTA TOURISM Srl, located in Lido degli Estensi (FE) - 44029 - Via Manzoni n.6 - VAT: 01956130387, represented by its current legal representative (hereinafter also referred to as the “Company”).

 

 

Purpose of the processing of personal data and legal basis for such processing

The Company will process your personal data for the following purposes:
 
a. (necessary) to execute the contract or pre-contractual measures as stated in the General Contract Terms and requested by you through the use of the Platform for booking and purchasing services marketed electronically;
 
b. (necessary) to comply with legal obligations related to the use of the Platform to which the Data Controller is subject under European and national regulations;
 
c. (with the user's consent) for promotional purposes through the use of the email address you provided during navigation and use of the Platform, for the sending of promotional material by the Data Controller and the Operators belonging to the INFERRARA network, also through the use of automated tools.

Legal basis for personal data processing

The legal basis for processing, pursuant to Article 6 of EU Regulation 2016/679, is the execution of the contract, as it is necessary to enable the booking, purchase, and use of the services offered through the Platform to the user and to fulfill the related legal obligations. Therefore, this processing of the user's data is necessary, as it is not possible to provide any service without involving the processing of the user's personal data by the Data Controller.

The processing for promotional purposes, on the other hand, is based on the user's express consent. By providing their email contact details, the user consents to the sending of promotional material, without prejudice to the user's right to withdraw such consent at any time.

Methods of processing

The Data Controller also informs you that your data will be processed using electronic tools and, if necessary, paper-based tools in the ways and to the extent necessary to pursue the purposes mentioned above, in compliance with the principles set out in Article 5 of EU Regulation 2016/679.
 
Within the organizational structure of the Company, personal data may be processed by authorized individuals specifically appointed by the Data Controller, or by any third parties involved in the processing, specifically appointed as external Data Processors, as necessary participants in the activities described in this information notice.
 
By way of example but not limited to, your data may therefore be communicated to and processed by:
 
- Providers of telematic services;
- Providers of electronic payment services and solutions;
- Feratel Media Technologies AG.
 
The complete and updated list of entities appointed as external Data Processors is available upon request from the Data Controller's office.
 

Data storage

The data provided will not be disseminated by the Data Controller and will be retained for the time strictly necessary to fulfill legal obligations and administrative, accounting, and tax requirements. Regarding the data provided through consent, it is expected that they will be retained for 5 years, subject to the right of withdrawal exercisable at any time by the data subject through the contacts indicated below.
 

Transfer of the data to a third country

The personal data collected may only be processed within the territory of the European Union.

Rights of the data subjects

As a "Data Subject", you have specific rights (Article 15 et seq. of EU Regulation 2016/679). 
Article 15 of the GDPR grants you the right to access your personal data held by the Data Controller, the current purposes for the processing, the categories of data processed and whether they are disclosed to third parties or transferred abroad. Furthermore, you have the right to obtain a copy when this does not infringe the rights and freedoms of others.
You also have the right to request the correction of inaccurate data and the deletion of those concerning you in accordance with Article 17 of the GDPR. You also have the right to request the restriction of processing in the cases indicated in Article 18 of the GDPR and to object at any time to CONTACT FORM PRIVACY POLICY REV. 01 - 10/10/2022 processing for marketing purposes or carried out by means of profiling, as well as to withdraw your consent at any time, without prejudice to the lawfulness of the data processing performed by the Data Controller based on the consent expressed prior to withdrawal. Finally, you have the right to receive a copy of your data in a commonly used and machine-readable format (portability - Article 20) and to lodge a complaint with the Italian Personal Data Protection Authority based in Rome.

This Privacy Policy is governed by Italian law and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, as well as national legislation on the sector.
